Title and Risk of Loss

Title to the products passes to you when we receive full payment for your order.

Risk of loss or damage passes to you when the product is delivered to the shipping address provided in your order, or otherwise transferred to the carrier, to the extent permitted by applicable law.

If your package is marked as delivered but you did not receive it, please contact the carrier first and then contact us at admin@franfusionus.com so we can review the situation.

FranFusion offers eligible returns and product support as described below.

To request a return, refund, replacement, or guarantee support, please contact us at admin@franfusionus.com with your order number and details of the issue.

Change-of-Mind Returns

For change-of-mind returns, customers may request a return within 30 days of delivery.

To be eligible, products must generally be:

• Unused.
• In original packaging.
• In “as new” condition.
• Returned with all accessories, instructions, inserts, patches, parts, and packaging included.
• Approved by FranFusion before being shipped back.

Customers may be responsible for return shipping costs for change-of-mind returns, unless otherwise required by law.

Original shipping fees may be non-refundable, unless required by law.

We reserve the right to refuse a return if the product is used, damaged, incomplete, altered, missing packaging, or not in eligible condition.

Final Sale and Non-Returnable Items

Products marked as Final Sale, Clearance, Non-Returnable, or similar at the time of purchase may not be eligible for returns, refunds, or exchanges, except where required by law.

Damaged, Defective, or Incorrect Products Upon Delivery

If you receive a damaged, defective, or incorrect product, please contact us at admin@franfusionus.com within 14 days of delivery.

FranFusion offers a 90-Day Guarantee for eligible product issues.

The 90-Day Guarantee begins on the date your order is delivered.

To activate the 90-Day Guarantee, you must contact us by email at admin@franfusionus.com and include:

• Your order number.
• Your full name.
• A description of the issue.
• Photos or videos clearly showing the product issue.
• Any other information reasonably needed to verify the claim.

If your claim is approved, FranFusion may, at its discretion, offer a replacement, repair, refund, store credit, or another reasonable solution.

The 90-Day Guarantee does not cover:

• Normal wear and tear.
• Damage caused by misuse, rough handling, or improper use.
• Damage caused by overinflation or improper inflation.
• Damage caused by sharp objects, pets, rough surfaces, outdoor hazards, or accidents.
• Damage caused by failure to follow product instructions or safety guidelines.
• Cosmetic wear that does not affect product functionality.
• Unauthorized modifications, repairs, or alterations.
• Products purchased from unauthorized sellers.

Proof of purchase is required. The 90-Day Guarantee applies only to eligible purchases and may not apply to products purchased through unauthorized resellers or secondhand channels.

FranFusion products are designed for family, kids, comfort, play, gaming, sensory-inspired relaxation, and lifestyle use, depending on the product.

You agree to use all products only as intended and in accordance with any instructions, warnings, weight limits, age recommendations, and safety guidance provided with the product or displayed on the Site.

Children should use products under appropriate adult supervision.

You are responsible for determining whether a product is suitable for your child, home, needs, space, and circumstances.

Inflatable Product Notes

Because some FranFusion products are inflatable, proper setup and use are important.

Please follow all inflation, care, setup, weight limit, and safety instructions provided with the product.

Damage caused by improper inflation, overinflation, misuse, sharp objects, pets, rough surfaces, outdoor hazards, failure to follow instructions, normal wear and tear, or unauthorized modifications may not be eligible for a refund, replacement, or guarantee claim.

Medical Disclaimer

FranFusion products are not medical devices.

Our products and any information provided on the Site, packaging, inserts, social media, advertisements, emails, or product materials are for general informational purposes only.

Our products are not intended to diagnose, treat, cure, prevent, or manage any disease, medical condition, developmental condition, sensory disorder, disability, injury, or behavioral condition.

Any references to comfort, calming, rocking, sensory play, movement, relaxation, focus, or self-regulation are general product descriptions and customer experiences only. They are not medical claims.

If you or your child has a medical condition, developmental condition, sensory need, injury, disability, or safety concern, consult a qualified healthcare professional, therapist, or specialist before using our products.

Use of our products or materials does not create a doctor-patient, therapist-patient, or healthcare provider relationship.

To the maximum extent permitted by applicable law, FranFusion and its owners, officers, employees, contractors, suppliers, affiliates, service providers, and partners will not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, loss of business opportunity, or personal inconvenience.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the Site, or any product purchased from us will not exceed the amount you paid to us for the product giving rise to the claim.

Some states do not allow certain limitations or exclusions of liability, so some of the above limitations may not apply to you.

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws that cannot legally be waived.

All content on the Site, including but not limited to text, graphics, logos, product names, product designs, images, videos, icons, trademarks, service marks, website design, product descriptions, packaging, marketing materials, and other content, is owned by or licensed to FranFusion.

By submitting User Content to us or tagging FranFusion on social media, you grant FranFusion a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, distribute, edit, adapt, modify, repost, and otherwise use your User Content for marketing, advertising, social media, website, product listing, email, and other business purposes, to the extent permitted by law.

You represent and warrant that:

• You own or have the necessary rights and permissions to share the User Content.
• The User Content does not infringe any third-party rights, including privacy, publicity, copyright, trademark, or intellectual property rights.
• You have obtained consent from any person appearing in the User Content.
• If a minor appears in the User Content, you are the parent or legal guardian or have obtained permission from the parent or legal guardian.
• The User Content is truthful and not misleading.
• The User Content does not violate any law or platform rule.

We reserve the right to remove, refuse, or stop using any User Content at our discretion.

We may offer promotions, discount codes, bundles, sales, giveaways, free gifts, or special offers from time to time.

Informal Resolution

Before starting a legal proceeding, you and FranFusion agree to first attempt to resolve any dispute informally by contacting the other party in writing.

The parties agree to attempt informal resolution for at least 30 days after written notice of the dispute, unless an exception applies.

Arbitration Agreement

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, your order, our products, or our Privacy Policy will be resolved by confidential, binding arbitration on an individual basis, rather than in court.

The arbitration will be administered by the American Arbitration Association (AAA) under its applicable consumer arbitration rules.

The arbitration will take place in Miami-Dade County, Florida, unless the rules or applicable law allow or require a different location or remote proceeding.

The language of arbitration will be English.

The arbitrator’s decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.

Exceptions

Either party may bring an individual claim in small claims court if the claim qualifies.

Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, or prevent unauthorized use of the Site.

Class Action and Jury Trial Waiver

To the fullest extent permitted by law, you and FranFusion agree that each party may bring claims only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, or representative action.

You and FranFusion waive any right to a jury trial to the fullest extent permitted by law.

Arbitration Opt-Out

If you are a U.S. consumer, you may opt out of the arbitration agreement and class action waiver by sending written notice to admin@franfusionus.com within 30 days after you first accept these Terms.

Your opt-out notice must include your name, email address, mailing address, and a clear statement that you wish to opt out of arbitration and the class action waiver.

Opting out does not affect any other part of these Terms.

These Terms and any non-arbitrable disputes will be governed by the laws of the State of Florida, without regard to conflict of law principles.

Subject to the arbitration agreement above, any permitted court proceeding must be brought in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires otherwise.

Notices to you may be sent to the email address, mailing address, phone number, or account information you provided when placing your order or creating an account.

Email notices are considered received when sent, unless the sender receives a delivery failure notice.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights or obligations under these Terms in connection with a merger, acquisition, sale of assets, restructuring, business transfer, or by operation of law.

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
